Discovery underway in cell phone wreck suit

Discovery is now underway in suit alleging a cell phone caused a distracted driver to strike a Beaumont woman’s vehicle in the middle of an intersection.

On Jan. 6 the Southeast Texas Record reported that Mina Green filed a lawsuit in Jefferson County District Court against Mariela Corona and Radillo Corona.

Less than a month later, a certificate of written discovery was filed, court records show.

The certificate, filed Jan. 30, provided notice of the defendants’ interrogatories to Green and requests for disclosure and production.

Green claims she and minor J. Bennett were riding in a vehicle traveling on Houston Street in Beaumont on Feb. 23, 2010, when Mariela Corona, who was driving a vehicle insured by Radillo Corona, struck their vehicle.

Mariela Corona was driving on Corley and had just entered its intersection with Houston Street, according to the complaint. She was talking on her cell phone upon impact and had failed to stop at the proper spot.

Green seeks an unspecified judgment, plus pre-judgment interest, costs and other relief the court deems just.

Jonathan C. Juhan and J.J. Bragg of Beaumont represent her.

The defendants are represented by Richard Hatfield of the Beaumont law firm Harris, Duesler & Hatfield.

Judge Donald Floyd, 172nd District Court, is assigned to the case.
